These terms govern use of the Sweet Desire website and purchases made through it. By using the website or placing an order, you agree to these terms. Nothing here removes a right or remedy that applicable consumer law does not allow us to exclude.
About Sweet Desire
Sweet Desire is the online intimate lifestyle store operated by the person or entity identified in the legal details at the end of this page. References to “Sweet Desire”, “we”, “us” or “our” mean that operator. References to “you” mean a website visitor, customer or account holder.
Eligibility and adult products
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase adult products. By ordering an age-restricted product, you confirm that you meet the age requirement and that the product may lawfully be purchased and possessed where you live.
We may cancel or refuse an order where we reasonably believe an age restriction, legal requirement, fraud control or safety concern has not been satisfied.
Using the website
You may use the website for lawful personal shopping and information. You may not interfere with its security or operation, introduce malicious code, scrape protected information, misuse another person’s account, submit false information, attempt unauthorised access or use the website in a way that violates law or another person’s rights.
We may suspend access where reasonably necessary to protect customers, the website or the business.
Product information
We aim to describe products, dimensions, materials, colours, features and availability accurately. Images and screen colours are illustrative and may vary. Packaging or minor specifications may change where a manufacturer updates a product without materially changing its purpose.
Read all manufacturer instructions, warnings, material details, compatibility guidance and care requirements before use. Information on the website and in The Sweet Guide is general education and is not medical diagnosis or treatment. Ask an appropriate healthcare professional about personal health concerns.
Prices and payment
Prices are displayed in South African rand unless stated otherwise. Applicable taxes, delivery charges and other mandatory costs are shown before the order is submitted where reasonably possible. Obvious pricing or description errors may be corrected.
Payment must be completed using a method offered at checkout. A payment authorisation or automated acknowledgement does not by itself mean that an order has been finally accepted. Payment providers process financial credentials under their own terms.
Orders and acceptance
Submitting an order is an offer to purchase the items in your basket. We may send an automated acknowledgement after submission. The order is accepted when we confirm dispatch or otherwise expressly confirm acceptance.
We may reject or cancel an order before acceptance because an item is unavailable, a price or product detail is materially incorrect, payment was not authorised, delivery cannot reasonably be completed, a purchase limit applies, or fraud or unlawful activity is suspected. If payment has already been collected for a cancelled order, it will be refunded.
Changing or cancelling an order
Contact us immediately if you need to change an address, item or order. We will assist where possible, but cannot guarantee a change after packing, fulfilment or dispatch has begun. Statutory cancellation rights and the Returns Policy still apply where relevant.
Subscriptions and recurring payments
Where a subscription product is offered, the product page and checkout will identify the recurring price, billing frequency, initial payment and any minimum or fixed period. By starting a subscription, you authorise the selected payment provider to collect recurring payments according to that disclosure.
You can review subscription details and available cancellation controls in My Account. Cancelling prevents future renewals after the cancellation becomes effective; it does not automatically reverse a payment already due or cancel an order already processed or dispatched. Any fixed-term or promotional conditions displayed when you subscribe also apply, subject to applicable law.
If a recurring payment fails, we may retry the payment, request an updated payment method, pause fulfilment or suspend the subscription. We will not dispatch an unpaid recurring order.
Delivery
Available delivery methods, charges and estimates are presented at checkout and explained on the Delivery page. Delivery dates are estimates unless expressly agreed as fixed. Delays may occur because of courier operations, remote locations, weather, public holidays, high order volumes or events outside reasonable control.
You are responsible for providing an accurate address and contact number and for arranging receipt. Contact us promptly if tracking shows a problem. Risk in goods passes as provided by applicable law and the agreed delivery arrangement.
Discreet packaging
Orders are sent in plain outer packaging without product names or suggestive images. A courier label must still contain the information required to deliver and return the parcel. See the Discreet Packaging page for more information.
Returns, refunds and faulty products
The Returns Policy forms part of these terms. It explains change-of-mind requests, hygiene-sensitive exclusions, incorrect deliveries, transit damage, defects, assessments and refunds.
Nothing in these terms limits the implied warranty of quality or another non-excludable right under the Consumer Protection Act. Where goods fail to meet applicable quality standards within the statutory period, the remedies available under law remain available.
Promotions, gifts and discount codes
A promotion may have additional dates, eligibility criteria, product limits or redemption terms. Unless stated otherwise, promotions cannot be combined, exchanged for cash or applied retrospectively. A promotion does not reduce statutory rights relating to faulty goods.
Customer accounts
You are responsible for keeping account credentials confidential and for activity carried out through your account unless caused by our failure to use reasonable safeguards. Tell us promptly if you suspect unauthorised access. Information submitted must be accurate and updated when it changes.
Reviews and submitted content
If you submit a review or other public content, it must be honest, relevant and lawful and must not expose another person’s private information. You retain ownership of your content but permit us to display, format and moderate it for operation and promotion of the store. We may remove content that violates these requirements or is misleading, abusive or unrelated.
Intellectual property
The website design, branding, copy, graphics and original content are owned by or licensed to Sweet Desire and protected by applicable intellectual-property law. You may view and use the website for personal purposes. You may not reproduce, sell, publish or commercially exploit protected material without permission.
Third-party services and links
The website may connect to payment providers, couriers, social networks and other third parties. Their services are governed by their own terms and privacy practices. We are not responsible for an unrelated third-party website merely because a link appears here.
Availability and website changes
We aim to keep the website secure and available but do not promise uninterrupted or error-free operation. Access may be limited for maintenance, security, upgrades or events outside reasonable control. We may update or discontinue website features, while continuing to honour accepted orders and legal obligations.
Liability
Nothing in these terms excludes liability or a consumer remedy that may not lawfully be excluded. To the extent permitted by law, Sweet Desire is not responsible for indirect or consequential loss that was not reasonably foreseeable when the transaction was concluded, or for loss caused by misuse, failure to follow instructions, unauthorised modification or use outside a product’s stated purpose.
Products must be inspected before use and discontinued if damaged or behaving unusually. Manufacturer warranties and instructions may apply in addition to statutory rights.
Privacy
Our Privacy Policy explains how personal information is processed, secured, shared and retained and how to exercise privacy rights.
Complaints and dispute resolution
Contact customer support first with the order number and a clear description of the concern. We will try to resolve complaints fairly and within a reasonable time. You may also use remedies available through the National Consumer Commission, a relevant consumer-protection authority, the Information Regulator or another competent body.
Governing law
These terms and transactions with Sweet Desire are governed by the laws of the Republic of South Africa. Any jurisdiction clause operates subject to rights you may have to approach a consumer body, tribunal or court under applicable law.
Changes, severability and entire agreement
We may update these terms for legal, operational or service changes. The terms displayed when an order is placed generally govern that order unless a change is required by law or agreed with you. If one provision is invalid or unenforceable, the remaining provisions continue to apply.
These terms, the order information, Privacy Policy, Returns Policy and any subscription or promotion terms shown at checkout form the agreement relating to your use and purchase.
Applicable framework
These terms are intended to operate consistently with the Consumer Protection Act 68 of 2008, Electronic Communications and Transactions Act 25 of 2002, Protection of Personal Information Act 4 of 2013 and other applicable South African law.
